Terms of use

Any purchase must be done through the activation of the “Place order” button that is shown at the bottom of the website when you go through the purchase request. With this you accept every single one of the General Conditions as they appear on Itoro’s web site before purchasing any of the products, without being applicable to the news that may occur in the clauses of the General conditions later.

Since the moment you accept the General Conditions as explained in this Terms of use, you as user, obtain the condition of Itoro’s client that is described in this Terms of use, the General Conditions. Any product or service that is offered after this by Itoro will be a part of a new hiring.

Itoro informs you that we keep all the electronic documents that are registered on the purchases.

3)   Prices, payment method, delivery and withdrawal

3.1 Prices

The prices of each product are the ones indicated on our website on the day of your purchase or order. All of our prices include taxes.

The offers will be clearly shown and marked, showing the previous price and the new price properly.

Itoro reserves the right to make the modifications it consideres appropriate at any time and without prior notice, and may update products and services on a daily basis depending on the stage of the market.

3.2 Payment method

Our customers can use the following payment methods to pay their orders:

• SOFORT (only in Austria/Germany)

3.3 Delivery and delivery expenses

The delivery of your orders depend on the method you chose. The timing of each delivery is shown in the purchase page.

We suggest you give us an address where someone can personally receive the package during working hours.

Itoro is not responsible of any customs cost. If this package is sent to the Canary Islands the client must respond to the expenses of the importation DUAS.

If you have any doubt about the delivery or any other incidence you can contact us here or write an email to office@itoro.at

If the client makes a mistake on the information about the delivery, he will be able to modify them by sending an email to office@itoro.at. If the mistaken information refers to the postal code of the address the client ask the delivery to be made to we will change the address to a new one only if the shipping hasn’t been made yet. If the shipping has already been made, the client will have to wait until the delivery gets to the first given address and then start the returning procedure.

3.4 Withdrawal

Our principal purpose is giving not only our costumer a good experience with our brand, also the environment has to be uplifted and taken care of. That is the reason why devolution or returning expenses are on the side of the customer..

All purchases can be returned or changed 14 days after the delivery.

Procedure:

Request the devolution by email to office@itoro.at. The request must be made within a period not exceeding 14 business days after receiving the product. The devolution must include the following information:

a)    The reason of the devolution.

b)    Its original packaging.

If the costumer does not present those requirements, the devolution could be denied.

If the costumer demands a size change, he can return the product in it´s original, undamaged and unused condition ask a refund and place a new order with the correct sizing.

If the costumer demands a refund and not a size change, you will get the amount you paid for in the same direction you executed the payment.

The language in which the contract between Itoro and the client will be written is English or German, English for international sales.

5)   Itoro’s Responsibilities

Itoro guarantees the quality of the service given through the website.

All the rights that the laws in force guarantee to consumers and users are guaranteed.

The neglect of any of this rights or General Conditions could provoque a devolution or cancelation of the services purchased by the client.

6)    Client’s Responsibilities

The client must make lawful use of the services, without contravening the current legislation, or injuring the rights and interests of third parties.

The client must guarantee the veracity and truthfulness of the provided information when he/she fills in the contract forms, avoiding the causing of damages to Itoro as a result of the incorrectness of the information.

The neglect of any of this requirements or conditions could give place to the retirement or cancelation of the services given by Itoro without the need of any previous warning to the client. In this case the costumer will have no right to any type of compensation.

7)    Industrial and Intellectual property

The Industrial and Intellectiual property rights that refer to works, brands, logos, or any other type susceptible of protection contained in the website of Itoro correspond exclusively to Itoro or to third parties that have authorized their inclusion in the website. The unauthorized reproduction, distribution, commercialization or transformation of such works, brands, logos, etc. is an infringement of the intellectual and industrial property rights of Itoro or its owner, and may result in the exercise of any judicial or extrajudicial actions that may correspond to them in the demanding of their rights.

With this being said, the information the client has access to through the website can be protected by industrial and property rights or other type of rights. Itoro will in no case be responsible or under any concept of the right infractions that the user can make.

9)    Jurisdiction and applicable law

If by any case, it appears to be any conflict of discrepancy in the interpretation or application of these contractual conditions, the Courts and Tribunals will be aware of the matter and will the ones that apply the legal regulations applicable in matters of competent jurisdiction, in which is addressed, in the case of final consumers, to the place where the obligation is fulfilled or that of the domicile of the buying party.

All this without the prejudice to the client’s faculty to go to the consumer arbitration board of their demarcation.

In the case of a trading made by a company, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Graz, Styria, Austria.
